The "Tink’s & Dead Down Wind Father’s Day Fishing Giveaway" 2024 Official Rules. NO PURCHASE NECESSARY. VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.

The "Tink’s & Dead Down Wind Father’s Day Fishing Giveaway" begins 10:00 a.m. Central Daylight Time ("CDT") June 1st, 2024 and ends 8:00 p.m. CDT on June 15th. There will be (5) prize packages (valued at $42.95) that will be randomly drawn during June 11th through June 15th.

The Giveaway will be run as a random chance drawing. To be entered, participants MUST like the Giveaway post (on Facebook or Instagram, or both,) that will be posted by 10:00 a.m. on June 1st, follow both the Tink’s and Dead Down Wind official pages (whether on Facebook or Instagram,) and tag someone in the comments of said social post (must tag a real person and not a bot or company account,) within the ‘entry period.’ The ‘entry period’ will be from 10:00 a.m. on June 1st through 8:00 p.m. on June 10th. Drawings for the (5) prize packages will take place on June 11th, June 12th, June 13th, June 14th and June 15th with one package being drawn for each of those days and the winner being announced on each corresponding day.

Who Is Eligible: Legal residents of the 50 United States or the District of Columbia who currently reside in the U.S (excluding Puerto Rico), who are at least 18 years old at time of entry. Employees, officers, directors and agents of Arcus Hunting ("Sponsor"), and each such entities' respective parents, affiliated and subsidiary companies, advertising and promotional agencies, web masters and web suppliers and the immediate family (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of each (whether or not related) are not eligible.

How to Enter: Beginning 10:00 a.m. CDT on June 1st, 2024 until 8:00 p.m. CDT on June 10th, 2024 (the "Entry Period"), you may Like the post (posted on June 1st and will be pinned on both the Tink’s and Dead Down Wind social media pages,) follow both the official Tink’s and Dead Down Wind official social media pages (whether on Facebook or Instagram,) and tag someone in the comments of aforementioned post (MUST be a real person that is tagged.) To be eligible, the participant MUST complete these (3) qualifications, but NO PURCHASE IS NECESSARY to be entered.

The prizes are not transferable. No cash redemptions or prize substitutions allowed, except at Sponsor's sole discretion. Prizes will be awarded. All costs, taxes, fees, and expenses associated with the prize or the acceptance and use of any element of the prize not specifically addressed above are the sole responsibility of the winner. The specifics of all aforementioned elements of the prize in the Giveaway shall be solely determined by Sponsor. Some restrictions may apply. Sponsor reserves the right to substitute the prizes, or portion(s) thereof, with a prize of comparable or greater value, at its sole discretion.

Winner Notification/Releases: The potential winners will be notified via the social media account they used to enter. The potential winners will have five (5) days from the moment such notification is issued to respond to such notification by following the instructions provided. The potential winners may be required to execute and return an affidavit of eligibility and release of liability and publicity (where permitted by law) within five (5) days of date of issuance of prize notification. Allow 4-6 weeks for prize delivery. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. If a potential winner does not reply to the notification within five (5) days of its issuance, is ineligible, or cannot or does not comply with the Official Rules, he/she will be disqualified, the prize will be forfeited and an alternate winner may be selected, at Sponsor's discretion, in a second chance drawing of all eligible entries received during the Entry Period. By entering, entrants agree (i) to be bound by these Official Rules, and (ii) that the decision of the Sponsor are final and binding on all matters relating to the Giveaway; (iii) to be contacted by Sponsor by email or telephone; and (iv) to release and hold harmless Sponsor, its parents, subsidiaries, affiliates, distributors, suppliers and advertising, Facebook, Instagram, promotional and judging organizations and each of their respective employees, officers, directors, shareholders and agents (collectively, the "Releasees") from and against any and all liability for injuries and/or damages (including death) sustained in connection with use and/or misuse of a prize or related to participation in the Giveaway. By accepting a prize, the winner consents to the use of his or her name for advertising, promotional and other purposes in any media as determined by Sponsor without further approval or compensation (except where prohibited by law). In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Giveaway at the actual time of registration will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry. All federal, state and local laws and regulations apply.

Entrants also acknowledge that any information provided as part of the Giveaway is being provided to the Sponsor and not to Facebook or Instagram.

Limitations of Liability: The Releasees are not and shall not be responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Giveaway; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing, typographical, human or other errors relating to or in connection with the Giveaway, including, without limitation, errors that may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prize or in any Giveaway-related materials; and any mail or entries which are late, lost, incomplete, misdirected, stolen, garbled, mutilated, illegible or postage due, or any combination thereof. If, for any reason, the Giveaway is not capable of running as planned by reason of infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, tampering, technical failures, or any other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, Sponsor reserves the right at its sole discretion to void suspect entries and/or to cancel, terminate, modify or suspend the Giveaway and select the winner from among all eligible entries received prior to such cancellation, termination or suspension.

Arbitration/Choice of Law: Except where prohibited, entrants agree that (i): any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway but in no event attorney's fees; and (iii) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Releasees in connection with the Giveaway, shall be governed and construed in accordance with the laws of the State of New York, without giving effect to principles of conflicts of law.
